There are times when governmental activities, without the formal eminent domain process, result in a “taking”.   This may occur when the government, through its activities, encroaches upon private property or establishes a new regulation that denies all beneficial use of private property.  Under these circumstances compensation for the “taking” may still be required.  Additionally, if governmental action restricts your use of the property, diminishing its value to you or for resale, you may be eligible for compensation under the Bert J. Harris, Jr., Private Property Rights Protection Act.
